Nigeria’s Appeal Court Sacks PDP’s Senator Iyiola Omisore

Iyiola OmisoreOrders A Rerun In 60 Days

This afternoon, Nigeria’s Federal Appeal court Ibadan division nullified yet again another ruling party (PDP) senatorial seat. The election of Osun State’s political Machiaveli Senator Iyiola Omisore who represents the State through the Osun East Senatorial District at the Senate.

The judges based their decisions on the widespread electoral malpractices and violence during the election held in April 2007, which were part of the indisputable arguments canvassed by the Action Congress (AC) Candidate, Hon. Babajide Omoworare.

Justice C.B. Ogunbiyi reading the judgement today held that the former senator should vacate his seat and that another election should be held within 60 days. The court however did not grant the prayers of the petitioner that Omisore was incompetent to run on account of his impeachment as deputy governor to Chief Bisi Akande in Osun State, saying that only a regular court can indict or disqualify a candidate standing for an election.

Omisore had won the senatorial election for his first term in 2003 while he was detained in Agodi Prison, Ibadan, in connection with the murder of the attorney general of the federation and justice minister, Chief Bola Ige. Ige was killed in December 2002. Omisore’s election at that time created some controversy as he was said to have even won resoundingly in Chief Bola Ige’s constituency of Esa Oke and Ilesa.

The Action Congress (AC) has asked Iyiola Omisore and all public officials whose elections were nullified by the courts to refund to the public coffers every kobo they collected while serving on stolen mandates.

Meanwhile, in a statement issued in London on Thursday by the Action Congress’ National Publicity Secretary, Alhaji Lai Mohammed (who is part of an AC delegation that is currently meeting with the chairman of the British All Party Parliamentary Group on electoral reforms in Nigeria), the party said it was unfortunate that a man without mandate has held a key post in the Senate as chairman of the Appropriations Committee, in addition to serving 30 out of 48 months.

“This brings to the fore the urgency of electoral reforms, the need to ensure that no elected official assumes office until all petitions against his/her election have been disposed off, and for elections to be held six months ahead of the expiration of the tenure of the incumbent administration, as recommended by the Justice Uwais panel but thrown out by President Umaru Yar’Adua.

“It is worth noting that while serving as a Senator without mandate, Omisore terrorised the opposition, even in matters that did not concern him, like the governorship re-run in Ekiti. We recall that this acting Senator was flown to Ekiti in a police helicopter for reasons yet unknown,’’ AC said.

The party hailed the judiciary for showing that some institutions in the country have not been overwhelmed by corruption, and commended Jide Omoworare, who challenged Omisore’s election, for his conviction and courage.

“It takes conviction and courage to take on a man like Omisore, who has a massive war chest from his days as deputy governor and a one-term Senator. We want men like Omoworare, who cannot be intimidated.

“It is precisely because we don’t have many men like Omoworare, because we have stopped asking questions, that the PDP has continued with its electoral heists,’’ AC said.

The party said the fact that Omisore’s election was annulled on the basis of wide spread violence and malpractices, among other reasons, shows that even he as a former deputy governor and serving Senator, as well as his party (PDP), were not on ground at all during the elections.

“This shows that all the PDP relies on to win elections is brigandage!’’ it said.

AC expressed the hope that the re-run ordered by the court would have credibility, saying it provides yet another rare opportunity for President Yar’Adua to demonstrate his administration’s so-called commitment to electoral reforms.

  1. I am not happy about this judgement. Omisore ought to have been disqualified from participating in the re-run. What have they achieved in calling for a re-run? Having confirmed gross irregularities in the said election with the cheat enjoying the elective office which he did not win for more than 2.5 years why do they need to call for a re-run for God’s sake? I am tired of injustice in this land. Besides, it was proved beyond resonable doubt that Omisore was impeached in 2003. Going by this, he is not qualified to cntest any elective position in the country. To me Appeal court has ordered for another round of mayhem, rigging, killing, harrassment, intimidation and all sorts in the affected senitorial distrcit. It is even better to leave him (Omisore) to enjoy the remainng 1.5 years inthe senate than this kind of ‘yeye’ re-run. I am very very very very very hangry about this.
    PDP will never change from what we know them for. Only God and fair judgement can save us.

  4. That is why l said we need to be more prayerful on our governorship matter.Omisore suppose to be disqulified anyway we have to thank God for the verdit.In as much as appeal court can said that they were convinced by Omisore’s irregularity during that election,Oyinlola too should be prepare.

  5. These PDP guys are heartless and the court have started to reveal the shaddy deal they did in 2007. The fact remain that AC are now vindicated. But my fear is that leopard will never change it’s skin. Anyway, it will be greed for greed, toe for toe this time around.

  12. This is yet another demoralising judgment in our fight for electoral freedom in Nigeria. Why the re-run? Would Omisore have resulted to rigging and voilence if he was truly loved by the electorates afterall he was
    the incumbent and his party (the destructive people’s people – taking the first P to the back) was also in power at both the state and federal levels.

    Nigerian judges ought to have learned that re-run is not what we need to bring sanity to our electoral system and at every opportunity like, Nigerians should be rescued from the hand of these mediocres who impose and parade themselves as leaders of the good people of Nigeria. The judges should have also saved the tax payers’ money by simply remove Omisore and order the swearing of the truly elected candidate. We know and the judges know that Omisore did not win any election and nobody would have the gut to say that the judges have not done well if they declared the AC candidate winner. Even, Omisore in his heart of hearts would have concurred with the judges if the AC candidate was declared winner – afterall he knew people didn’t vote for him in the first place.

  13. May the like’s of Omisore never be senator in Nigeria. He will soon join his elder brother in Kirikiri. The next judgment that people of Osun are waiting for is that of Oyinlola. I can sincerely Informed all Osun that come December, Oyin will not return to Govt. house by January, he will just be coming from Okuku to Abere every day till the final judgment from Ibadan.

  14. This is just the begining of muderer (OMISORE) downfall.After this one by the grace of God, he is going to lose in the election and later end up his life in prison like how his god father BOY GORGE is serving in prison now with grey hair.

  15. Omisore downfall begins today and more is to follow. No PDP is different from the other whether Oyin, Bode George, Agagu, Segun Oni, etc. a typical PDP man or woman is either a killer, assasin, rigger or at simplest form- a fraudulent person therefore we expect our judiciary to sanitise the country by flushing out these elements with a more appropriate judgement like declaring Omoworare outright winner.

  16. Bloodshed should be a great concern of every sane person and that the person should try to use all he has in power to prevent it. Polling days have ever been days of mayhems,killings, maiming and rigging in Nigeria. No one ordered for killing and maiming other than those found guilty of gross election malpractice. Then it is an opportunity for a judge who will not be happy to see that his/her judgement causing bloodshed to summarily remove a guilty person from his/her seat of power and place them in jail for life. This will be reducing the No of killers in our society. Hence the Re-run ordered by the appeal court on the case of Omisore is simply order of Re-killings, Re-rigging, Re-maiming, etc as those killed before could not be victims again but another people! Definitely, Omisore and his devilish people will repeat another round of mayhem. Why our justice are blood suckers to be passing this kind of judgement under the camouflag of maintaining the justice? This is purely self-rubbising ATTITUDE of the appeal court just as it ordered re-trial of Aregbe’s pettition.

This judgement is nonsense plus nonsense………………….the judiciary is just playing lip service to real justice.first was the ekiti re-run when fayemi should have been declared after obtaining the highest lawful votes after the order of mimiko and oshiomole……………………………..now another re-run under ewu iwu after the arise stolen senatorial seat…………………………..This is unfair……………………….but am more than re-assured that change is coming soon.Naija will never go down like this ooooooooooo.never!!!!!

  19. The judgement does not drive the points home wholesomely but it is a pointer that all was not well with the election that made Omisore a senator. But,imagine someone that stole mandate was in the house,with a crown king in iljesaland praying House to grant them oduduwa state suddenly fell from that corridor that gave him that priviledge! The question now is this,do you think Ooni,Olashore and their cronies will not act again their old script? I doubt if they will want to swallow their pride apple! So,end has not come to terror in the senatorial district,Omisore might resolve to somethingelse……..do or die sydrome!

  21. Let wait and see, time will surely tell who actually has the mandate of Ife/Ijesha senatorial district? I want to assure you that if Omisore stands for any election against any AC member in Osun state including your despotic national chairman Bisi Akande hundred times, Senator Iyiola Omisore would emerge victorious hundred times. Jide is very small and can not march him even despite AC’s rented crowd from Lagos and other neighbouring states. Nobody is afraid of AC and its imported candidates, a party without focus and vision for the good people of osun state and most importantly, Ife/Ijesa senatorial district. My advise to Jide is for him not to waist Lagos state money this time around, though unlike ojuyobo, Fashola is more focused than waisting his state’s resources on a futile project of retrogression embarked upon by AC in Osun state. A stitch in time saves nine. Let’s meet at the re-run if you’re still lost at the overwhelming grassroot support enjoyed by Senator Omisore in Ife/Ijesha and Osun state in general. Osun state is a no go area for you people, pls keep off.

The fact remains that Omisore is a political thug like Adedibu dont you know the song you usually sing for him ! ife (Ife naa lomisore bi ibadan se ladedibu ife naa lomisore). A senator that has been in the senate fot about seven years yet you never could hear him talk in the senate except to support the motion as usuall.
